SUCCESSMP3S.COM TERMS OF USE
THIS IS A LEGAL AGREEMENT BETWEEN YOU AND SUCCESSMP3S.COM. (“SUCCESSMP3S”) STATING THE TERMS THAT GOVERN YOUR USE OF THE SUCCESSMP3S SERVICE (THE “SERVICE”). THIS AGREEMENT – TOGETHER WITH ALL UPDATES, ADDITIONAL TERMS, AND ALL OF SUCCESSMP3S’S TERMS AND CONDITIONS OF USE, PRIVACY POLICY, AND OTHER RULES AND POLICIES – COLLECTIVELY CONSTITUTE THE “AGREEMENT” BETWEEN YOU AND SUCCESSMP3S. USE THE SERVICE SHALL CONSTITUTE YOUR AGREEMENT TO BE BOUND BY THE TERMS HEREIN.
1. The Service
The Service offers you the ability to purchase and download digital content, including sound recordings and audio-visual recordings (individually and collectively, “Digital Content”) under the terms and conditions in this Agreement.
2. Digital Content; Downloading
Upon your payment of our fees for Digital Content, we grant you a non-exclusive, non-transferable right to use the Digital Content for your personal, non-commercial, entertainment use, subject to and in accordance with this Agreement. You will have thirty (30) days from the date of payment (the “Window”) to download the purchased Digital Content onto your hard drive. The number of times you may download the purchased Digital Content during the Window will be determined by the licensor and noted at the time of your purchase but will not exceed three (3) times during such Window. You are responsible for backing up and maintaining the Digital Content so that you may still use your purchased Digital Content after the 30 day period expires. You may copy, store, transfer and burn the Digital Content only for your personal, non-commercial, entertainment use, subject to and in accordance with this Agreement.
3. Objectionable Material
You understand that by using the Service, you may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language. Nevertheless, you agree to use the Service at your sole risk and that SUCCESSMP3S shall have no liability to you for content that may be found to be offensive, indecent, or objectionable. Content types and descriptions may be provided for convenience, and you acknowledge and agree that SUCCESSMP3S does not guarantee their accuracy.
4. Charges, Payment and Pricing of Digital Content
4.1 The SUCCESSMP3S Music Store accepts payment by credit cards, including Visa, MasterCard, American Express and Discover. SUCCESSMP3S may obtain a pre-approval from the credit card company for an amount up to the amount of the order. Except as otherwise provided in Section 4.2 below, billing to your credit card occurs at the time of purchase or shortly thereafter. Your credit card will be charged one time for the purchase of multiple Digital Content made in one transaction. An email receipt will be sent to the email address provided in your Registration Data, defined below, for each transaction for the purchase of Digital Content.
